1. scope of application
These General Terms and Conditions (GTC) govern the legal relationship between customers, hereinafter referred to as guests, and the Hotel Alpina, hereinafter referred to as the hotel. Insofar as the term guest is used below, this also includes the female or gender-neutral form. The GTC apply to all contracts for accommodation services and/or events, including the associated services. For the sake of simplicity, the term "contract" is always used in these GTC, regardless of the service in question. The contractual partners are the guest and the hotel. Should individual provisions of these GTC be ineffective or invalid, this shall not affect the validity of the contract and the remaining GTC provisions. The place of jurisdiction for any disputes arising from this contract is Lucerne, unless another legally binding place of jurisdiction exists. Swiss law shall apply exclusively to all contractual, reservation and any additional agreements and the General Terms and Conditions. The place of performance and payment is Lucerne.
2. conclusion of contract
The contract for the rental of rooms and other rooms within the hotel as well as outdoor areas belonging to the hotel's property, as well as the purchase of other goods and services, is concluded with the written confirmation of the guest and the hotel. Electronically transmitted documents such as e-mails and forms generated online shall also be deemed written confirmations. The agreed services are legally binding for the hotel and the guest in every respect.
3. prices
The prices communicated by the hotel are in Swiss francs (CHF) and include statutory VAT. Any increase in statutory charges after conclusion of the contract shall be borne by the guest. Prices are subject to change at any time.
4. payment modalities
4.1 Down payment / advance payment
The hotel will debit the entire booked service with the specified payment method as soon as the booked service can no longer be canceled free of charge. If the deposit is not paid on time, the hotel may withdraw from the contract (including all service promises) immediately (without reminder) and demand cancellation costs.
4.2 Charging the credit card
By providing the credit card details when booking, the guest agrees to this being charged. A receipt is therefore also valid without signature or entry of the credit card number.
4.3 Final invoice
The final invoice shall include the agreed price plus any additional amounts incurred as a result of additional services provided by the hotel for the guest and/or the persons accompanying the guest. The final invoice must be paid in Swiss francs in cash or by accepted debit or credit card at the latest at check-out on the day of departure. Invoices that are sent by agreement must be paid within 10 days of the invoice date. The full billing address must be provided with the definitive reservation. The guest is liable for any unpaid invoices of individual participants. The invoiced amount must be paid without deduction. No rebates or discounts will be granted on the amount owed.
4.4 Dunning procedure
No costs will be charged for sending a first reminder. A processing fee of CHF 50 and any default interest of 5% p.a. will be charged for each subsequent reminder.
4.5 Invoice amendment
If the billing address is changed after the invoice has been sent, a processing fee of CHF 20 per invoice will be charged.
5. options, offers
5.1 The acceptance deadlines for offers made by the hotel are set out in the respective offer. Thereafter, the hotel is no longer bound by the offer.
5.2 Option dates arebinding for both parties. The hotel may dispose of the services offered without further notice after the option period / offer has expired unused.
5.3 Rooms are always offered without obligation. Prior sale is therefore possible at any time.
6. reservation, arrival and departure
6.1 A reservation made on the day of arrival itself is binding at the moment of acceptance by the hotel.
6.2 Arrival If, for unforeseen reasons, the booked room category is not available on arrival, the guest will be allocated a room in the next higher category.
6.3 If, despite a confirmed reservation, no rooms are available in the hotel, the hotel must offer the guest an equivalent replacement in a nearby hotel (25 km as the crow flies) of a comparable or higher category. Any additional expenses for the alternative accommodation shall be borne by the hotel. If the guest refuses the alternative room, the hotel must immediately refund any payments already made by the guest (e.g. deposits). The guest shall have no further claims.
6.4 Unless otherwise agreed, the guest has the right to use the rented rooms from 3 p.m. on the agreed day of arrival until 11 a.m. on the day of departure.
6.5 If the guest departs early, the hotel is entitled to charge 100% of the total booked services.
6.6 The hotel room is reserved exclusively for the registered guest or guests. The transfer of the room to a third person or its use by an additional person requires the hotel's approval.
6.7 The scope of the contract is determined by the individual reservation made and confirmed by the guest.
6.8 The customer may only use the rooms for the agreed purpose.
7 Cancellation and rebooking
Cancellations of 1 to 4 hotel rooms are free of charge up to 48 hours before arrival. In the event of a later cancellation or no-show, the full cost of the stay will be charged. If the booking guest registers additional guests, he/she is liable for the entire invoice amount resulting from the reservation. Exceptions to these cancellation costs, e.g. during trade fairs or dates defined by the hotel, can be found in the booking confirmation.
8. group reservations Definition
Room reservations with a minimum number of 5 booked rooms are deemed to be groups within the meaning of these GTC.
9. list of names
The final list of names of each member of the respective group must be communicated to the hotel up to 14 calendar days before arrival.
10 Cancellation and rebooking
Cancellation is free of charge up to 42 calendar days before arrival. In the event of a later cancellation, the following charges apply:
41 to 22 days before arrival 50% of the contractually agreed service
21 to 0 days before arrival 100% of the contractually agreed service
Further provisions
11. right of withdrawal
The hotel is entitled to withdraw from the contract at any time (even after the normal cancellation period) for objectively justified reasons by means of an immediate, unilateral and written declaration with immediate effect. Objectively justified reasons include, for example:- an agreed advance payment or security deposit is not made within the period set by the hotel;- force majeure (pursuant to Art. 119 OR) or other circumstances for which the hotel is not responsible and which make fulfillment of the contract objectively impossible;- rooms or rooms booked under misleading or false information, e.g. the hotel has reasonable grounds to assume that the use of the agreed services may impair the smooth running of the business, the safety of other hotel guests or the reputation of the hotel;- the guest has become insolvent (bankruptcy or unsuccessful seizure) or has suspended payments;- the purpose or reason for the stay is unlawful. In the event of withdrawal by the hotel for the aforementioned reasons, the guest shall not be entitled to any compensation and the compensation for the booked services shall remain due in principle.
12. internet
The hotel provides the guest with free access to the Internet (WLAN). The guest is responsible for the use of the login data. The guest is liable for misuse and illegal behavior when using the Internet.
13. smoking
Smoking is not permitted anywhere in the hotel. An amount of CHF 350 will be charged in the event of non-compliance.
14. liability
Any personal items brought into the hotel are at the guest's risk in the rooms or on the hotel premises. The hotel assumes no obligation to guard or store such items. The hotel accepts no liability for the loss of or damage to items brought into the hotel, except in cases of gross negligence or intent on the part of the hotel. The guest is responsible for insuring any items brought into the hotel. If valuables such as jewelry, cash or securities are not handed over to the hotel for safekeeping, the hotel's liability is excluded to the extent permitted by law. The hotel shall not be liable to the guest to the extent permitted by law for slight and medium negligence and shall only be liable for damage caused intentionally or by gross negligence. Should disruptions or defects occur in the hotel's services, the hotel shall endeavor to remedy the situation upon immediate notification by the guest. If the guest fails to notify the hotel of a defect in good time, there shall be no entitlement to a reduction in the contractually agreed remuneration. The guest is liable to the hotel for all damage and loss caused by him, his companions or assistants, without the hotel having to prove fault on the part of the guest. The guest is liable to third parties for services and expenses incurred by the hotel. If a third party makes the booking on behalf of the guest, he shall be liable to the hotel as the ordering party together with the guest as joint and several debtors for all obligations arising from the contract. Irrespective of this, each customer is obliged to forward all information relevant to the booking, in particular these General Terms and Conditions, to the guest.
15. dogs
Dogs may only be brought into the hotel with the prior consent of the hotel and for a special fee of CHF 20 per day. Guests who bring an animal into the hotel are obliged to keep and supervise this animal properly during their stay or to have it kept or supervised by a suitable third party at their own expense. The guest shall bear the costs of repairing any damage or soiling caused by the animal.
16. lost property
Lost property will be forwarded if the ownership is clear and the residential or business address is known. The guest bears the costs and risk of forwarding.
17. media
Advertisements in the media (such as newspapers, radio, television, Internet) using the company logo or photos require the prior written consent of the hotel.
